Key terms to know
Fiduciary duty
The legal obligation of an agent to act in the best interests of their client above all others, including their own interests.
Earnest money deposit
A good faith deposit made by a buyer when submitting an offer. Applied toward the purchase price at closing or returned if the transaction fails under a contingency.
Statute of Frauds
A legal requirement that certain contracts, including real estate purchase agreements and leases over one year, must be in writing to be enforceable.
Procuring cause
The agent whose actions directly resulted in the successful completion of a sale. Determines who earns the commission when multiple agents are involved.
