Key concepts
Real property vs personal property
Real property is land and anything permanently attached to it. Personal property is movable and not attached to land.
Bundle of rights
The rights of possession, use, enjoyment, encumbrance, and disposition that come with property ownership.
Encumbrances
Claims against property that limit ownership. Includes liens, easements, deed restrictions, and encroachments.
Joint tenancy vs tenancy in common
Joint tenancy requires TTIP and includes right of survivorship. Tenancy in common allows unequal shares with no survivorship.
Government rights (PETE)
Police power, Eminent domain, Taxation, and Escheat. The four powers that can limit or transfer private property.
Zoning and land use
Local governments control land use through zoning ordinances. Non-conforming uses may continue if established before the zoning change.
